Minnesota DA Issues Arrest Warrant for ICE Agent, Escalating State–Federal Clash

Senate Minority Leader Chuck Schumer (D-NY), House Minority Leader Hakeem Jeffries (NY-08), California Governor Gavin Newsom, and others have been criticizing Immigration and Customs Enforcement (ICE) for months, referring to them as the Gestapo and other inflammatory terms.

California gubernatorial candidate Tom Steyer is advocating for aggressive action against the federal law enforcement agency. His statements raise, um, ‘concerns’ about his judgment.

Yesterday we reported that Hennepin County District Attorney Mary Moriarty significantly increased the stakes on Thursday by charging an ICE agent, 35-year-old Gregory Donnell Morgan Jr., with two felony counts of second-degree assault for actions he committed while on duty.

Moriarty, the first LGBTQ person in her role, the media constantly remind us – as if that is supposedly some sort of enhancement on her ability to enforce laws – gave a stern press conference during which she declared: “There is now a warrant for Mr. Morgan’s arrest, which allows law enforcement to arrest him anywhere in the country.”

(The tweet says two ICE agents, but we’ve confirmed that it’s only one):

The tweet adds:

Minnesota really wants to go to war with the federal government under President Trump. Bring it.

The proper federal response needs to happen right NOW. The DOJ under @AGTtactical must immediately move to quash these unconstitutional warrants, open an investigation into Moriarity for obstruction of federal law enforcement, and make it crystal clear that no state or local prosecutor gets to order the arrest of federal agents doing their job. Complete insanity.

Agree with all of that.

Here’s a concise summary of the incident: In February, two agents were driving at high speed on the shoulder of a highway in Minneapolis in an unmarked SUV. Another driver became frustrated with their driving and swerved to cut them off.

In response, the agents pulled up alongside the other vehicle, and one of them, Morgan, allegedly pointed his gun at the occupants, which included a woman in the passenger seat. The agents later claimed that they rolled down their window and shouted, “Police!”

In response, the occupants of the car took a picture of the agents’ license plate and called 911. Local authorities subsequently located and questioned the agents in a parking lot. The agents expressed that they believed they were being harassed because they worked for ICE and noted that such incidents had become a daily occurrence for them:

Interestingly, DA Moriarity thought it was funny that the people cut off the agents. “Like some Minnesotans, he’s ticked off about this,” she said about the driver. “It’s one lane, right? So he moves over a little bit to impede. Classic Minnesotan.”

Funny ha ha, almost causing a major accident. Now that’s comedy, folks.

Remember, this is the same woman who hasn’t found time to file charges against the man who assaulted journalist/TPUSA contributor Savannah Hernandez while she was covering an anti-ICE protest in Minneapolis on Sunday.

All of which is on video, by the way (can you say ‘open-and-shut case’?):

The legal issues here are complicated – or are they? (supremacy clause, anyone?), but I’ll leave that to the legal eagles to figure out. If this agent is arrested, however, this is going to get bad in a New York minute.
